1. Where to send notices

Send copyright notices to our designated agent:

Copyright Agent, Wells Software Consulting LLC (IFHosting)
1 E Erie St, Suite 525-2098, Chicago, IL 60611
(312) 313-3883
[email protected], subject line "Copyright notice"

We act as a storage provider under section 512(c) of the Digital Millennium Copyright Act for material on customer servers, and as a transmission provider under section 512(a) for traffic passing through our network.

2. What a notice must include

  1. Your physical or electronic signature, as the owner or someone authorized to act for the owner.
  2. The copyrighted work you say is infringed, or a representative list if there are several.
  3. The material you say infringes, with enough detail for us to find it, such as a URL or IP address and path.
  4. Your name, address, phone number and email.
  5. A statement that you believe in good faith the use is not authorized by the owner, its agent or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner.

If a notice is missing some elements but identifies the work, the material and how to reach you, we will contact you to complete it.

3. What we do

When a notice is complete, we act quickly to remove or disable access to the material. Because we cannot remove individual files from a customer's server, we first forward the notice to the customer and ask them to act within 48 hours, or sooner where needed. If they do not, disabling access may mean null-routing an IP address or suspending the server. We promptly tell the customer that the material was removed or access to it disabled. Notices are forwarded with the sender's contact details.

4. Counter-notices

If you believe material was removed by mistake or misidentification, send a counter-notice to the same address with: your physical or electronic signature; the material removed and where it appeared; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; and your name, address and phone number, with your consent to the jurisdiction of the federal district court for your address (or, outside the US, any district where we may be found) and to accept service from the person who sent the notice or their agent.

When we receive a valid counter-notice, we send a copy to the person who sent the original notice and tell them we will restore the material in 10 business days. We restore it no sooner than 10 and no later than 14 business days after we receive the counter-notice, unless that person first tells us they have filed a court action to stop the infringement.

5. Repeat infringers

We keep a record of valid copyright notices for each customer. A customer who receives three valid notices within 12 months that are not resolved by a valid counter-notice is a repeat infringer, and we end their Services. We may act sooner in serious cases.

6. False claims

Knowingly misrepresenting that material infringes, or that it was removed by mistake, can make you liable for damages under section 512(f). If you are unsure whether a use infringes, get legal advice before sending a notice.
